A practical approach to identifying obligations, assessing their impact, evaluating compliance and reporting results to management.
ITVC GLOBAL · KNOWLEDGE AND NEWS
Legal compliance management under ISO 14001:2004 and ISO 50001:2011. Check the applicable edition and current legal obligations before using clause references or planning an audit.
The environmental management discussion emphasized identifying relevant legal and other commitments, obtaining access to them and determining how they apply to the organization’s environmental aspects.
The energy management discussion applied the same discipline to energy use, consumption and efficiency: identify requirements, determine their application, review them at defined intervals and consider them when establishing and maintaining the system.
Periodically assess performance against applicable obligations and retain the results. Evaluation of other commitments may be combined with legal compliance evaluation or managed through a separate process. A register of laws alone does not demonstrate compliance.
Useful information sources include official gazettes, authoritative government websites, competent authorities and qualified advisers. The organization should assign responsibility and require a periodic update record, even when no relevant change is found.
Industrial-zone notifications could help companies, while facilities outside such zones sometimes missed updates. Each organization nevertheless needs its own reliable review process.
Record the assessment, required actions, responsible people and completion dates. Update operational controls and documents where needed.
Possible internal status categories include: compliant, minor gaps, significant noncompliance, noncompliant and not applicable. These are management aids, not official ISO grades or legal permissions. A “minor gap” can still represent a breach and requires appropriate action; “not applicable” needs a documented basis.
For each obligation, identify objective evidence, the result, any gap and the corrective action. Avoid a single overall score that hides an unmet requirement.
A twelve-month review is one planning example. The interval should instead reflect the obligation, risk, operating cycle, changes and availability of evidence. Some checks require shorter intervals or immediate review after a change.
Report significant gaps, recurring issues, resource needs and completion of actions to management. This links compliance evaluation to decisions and continual improvement.
